To the access and use of the website www.numberingplans.com (hereinafter referred to as "the Website") the following terms of use apply. By using and continuing to use the Website you explicitly agree to these terms of use, last updated on 23 March 2009.
Article I - Liability
The information on the Website may contain inaccuracies or typographical errors and may be changed or updated without notice. All documents and information on the Website are provided without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. International Numbering Plans does not represent that the use of the information contained in the Website does not infringe upon the rights of third parties.
In no event will International Numbering Plans be liable to any party for any direct or indirect, special or other consequential damages for any use of the Website, including, without limitation, any lost profits, business interruption, loss of programs of other data or otherwise, even if International Numbering Plans is expressly advised of the possibility of such damages. Liability for direct damages can only arise in the relationship between International Numbering Plans and a party for whom International Numbering Plans performs services in the context of an agreement, within the limits of the General Terms and Conditions of International Numbering Plans.
Article II - Intellectual property
All intellectual property rights, including but not limited to database rights and/or copyrights. as to the Numbering Plan Database operated by International Numbering Plans, publications, software, documentation and all other materials developed and/or used in preparation of or for the performance of services, rendered by International Numbering Plans or that may result from these, shall remain exclusively vested in International Numbering Plans. The performance of services by International Numbering Plans shall never lead to any transfer of intellectual property rights.
As a user of the Website you agree to use the Website for lawful purposes only. Your use of the Website will not infringe upon the rights of any other party.
Article III - Personal data protection
International Numbering Plans respects the privacy of users of the Website. International Numbering Plans shall make every effort to comply with applicable legislation regarding the processing of personal data, in particular the Dutch Data Protection Act ("Wet bescherming persoonsgegevens").
International Numbering Plans will not hand over any personal data of users of the Website to third parties, except when this is allowed by the provisions in the Dutch Data Protection Act, when the user has granted permission, or when it is obliged to do so. Such an obligation can exist inter alia when International Numbering Plans receives an order issued by a legal authority or when a refusal to hand over personal data in the opinion of International Numbering Plans would constitute an unlawful act towards a third party. International Numbering Plans shall not be liable for damages suffered by user as a result of handing over personal data by International Numbering Plans, even if it is afterwards determined that there was no legal obligation to do so.
Third-party advertising partner Google AdSense uses DoubleClick DART cookies to serve ads to enables it to serve ads to users based on their visit to this website. International Numbering Plans has no access to or control over these cookies. Users may opt out of the use of DART cookies by visiting the Google ad and content network privacy policy.
The user shall indemnify International Numbering Plans against all third-party claims which may be filed against International Numbering Plans because of an (alleged) violation of the Personal Data Protection Act and/or other laws concerning processing personal data which is not imputable to International Numbering Plans.
Article IV - Applicable law
The provisions in these Terms of Use shall be governed by the Law of the Netherlands.
Any disputes that may arise under or in connection with the provisions in this Disclaimer shall be exclusively submitted to the competent court within the District of Zutphen, the Netherlands.
